This Privacy Policy explains how Moonway LLC collects, uses, stores, discloses, and otherwise processes personal information when you access or use Services, including websites, applications, online platforms, digital services, account features, subscription features, customer support channels, and related communications.

We use this information to provide the Services, personalize your experience, process purchases, subscriptions, payments, cancellations, and refunds, maintain security, prevent fraud, analyze how users interact with the Services, improve our products, and, where permitted by law, send marketing or measure advertising.

Depending on where you live, you may have privacy rights, including rights to access, delete, correct, or receive a copy of your personal information, opt out of targeted advertising or certain sharing of personal information, appeal certain privacy decisions, and use an authorized agent. “Company,” “we,” “us,” and “our” refer to Moonway LLC.

“Platform Owner” means the owner or operator of the underlying System, Services, software, platform, technology, digital content, tools, models, features, and intellectual property used to provide the Services.

“you” and “your” refer to the person whose personal information we collect or process.

“Services” means the subscription-based digital tools available through OMPERTY at www.omperty.com and through any related website, web app, mobile app, or other digital platform. The Services use artificial intelligence and automated data tools to help match real estate listings and market information with the preferences you provide, such as your preferred location, budget, property type, and lifestyle needs. The Services may provide personalised listing and market reports, alerts about new or updated listings, price changes, and similar or alternative properties. OMPERTY may also offer, or connect you with third parties offering, optional services relating to other goods or services, such as boats, vehicles, or relocation assistance. The Services are provided for general information only. OMPERTY is not a real estate agent or broker and does not buy, sell, lease, manage, appraise, or hold an interest in any property. OMPERTY also does not provide financial, legal, tax, insurance, medical, or other professional advice. Information, reports, alerts, and other content available through the Services are not a recommendation, offer, property valuation, or professional advice.

We may process personal information together with, or disclose personal information to, the Platform Owner and its affiliates, service providers, licensors, or platform providers where necessary to operate, provide, secure, support, improve, sell, or administer the Services.

2. Scope of this Privacy Policy

This Privacy Policy applies when you:

  • visit or use a website, application, platform, or other digital product we offer;
  • create, access, or manage an account;
  • purchase, subscribe to, or use any of the Services;
  • communicate with us, including through email, support channels, forms, or social media;
  • receive marketing or service communications from us;
  • participate in surveys, testing, promotions, or feedback activities; or
  • otherwise interact with us in connection with the Services.

This Privacy Policy does not apply to third-party websites, applications, platforms, or services that we do not control, even if they are linked from or integrated with the Services.

The personal information we collect depends on how you interact with us and which Services you use. We may collect personal information that you provide directly, personal information collected automatically, and personal information received from service providers, payment processors, platform providers, or other sources.

3.1. Information you provide directly

  • Account information. This may include your email address, login credentials, account identifiers, account settings, profile details, preferences, and other information used to create, manage, or secure your account.
  • Service information. This may include information you provide when selecting, configuring, purchasing, accessing, or using the Services, including preferences, goals, settings, responses, selections, usage choices, feature inputs, form submissions, onboarding answers, transaction-related details, and other information you choose to provide through the Services.
  • Communications. This may include support requests, emails, messages, complaints, refund requests, privacy requests, survey responses, feedback, reviews, and other communications you send to us.
  • Content and materials. This may include text, files, prompts, responses, images, audio, video, documents, preferences, outputs, or other content or materials you choose to upload, submit, generate, transmit, or provide through the Services.
  • Optional information. We do not require you to provide your full name, phone number, job title, company name, government identification number, or similar identifying details unless they are necessary for a specific Service, payment, legal requirement, support request, verification process, or feature that you choose to use.

3.2. Purchase and subscription information

When you purchase or subscribe to the Services, we may collect or receive transaction identifiers, payment status, billing history, subscription plan, renewal status, cancellation status, refund status, purchase date, renewal date, charge amount, payment provider information, and limited payment details such as card type, card expiry date, and the last four digits of a payment card where applicable.

We do not intend to collect or store full payment card numbers ourselves unless expressly stated otherwise.

3.3. Information collected automatically

When you use the Services, we may automatically collect technical and usage information, including IP address, device information, browser type, operating system, language settings, approximate location inferred from IP address, time zone, website or app usage, log data, session data, diagnostic data, error reports, referral information, page views, feature interactions, interaction events, and similar information.

3.4. Cookies and advertising information

We may collect cookie identifiers, advertising identifiers, where applicable, analytics information, pixel events, referral data, and online interaction data through cookies and similar technologies, as described in Section 6.

3.5. Information from service providers and third parties

We may receive personal information from service providers, payment processors, fraud-prevention providers, analytics providers, customer support tools, advertising or marketing providers, the Platform Owner, affiliates, app stores, payment platforms, or business partners where relevant to the Services.

3.6. Sensitive personal information

We do not intentionally collect sensitive personal information unless it is necessary for a specific Service, support request, security purpose, legal requirement, or feature that you choose to use. If we collect information treated as sensitive under applicable U.S. state privacy laws, we will use it only as permitted by law and as described in this Privacy Policy.

We do not use sensitive personal information for purposes that require a right to limit under California law unless we provide the required notice and choice.

We do not sell your personal information for money. We do not share your phone number or email address with third parties or affiliates for their own marketing or promotional purposes.

We may use this information to communicate with you, respond to inquiries, manage our social media presence, moderate content, understand engagement, and promote the Services.

The relevant social media platform may also process your personal information for its own purposes, including account management, analytics, advertising, security, and platform improvement. We do not control how social media platforms process personal information for their own purposes.

Platform Owner, affiliates, platform providers, and operational partners. This may include account information, service information, communications, technical and usage information, content and materials, purchase or subscription status, and other information necessary for the Services.

Payment, billing, subscription, and transaction providers. We may disclose personal information to providers that process purchases, payments, subscriptions, renewals, cancellations, refunds, billing, receipts, chargebacks, fraud checks, and payment-related support. This may include account information, purchase and subscription information, limited payment details, transaction information, technical information, and communications.

Payments may be processed by third-party payment providers. We do not intend to store full payment card details ourselves unless expressly stated otherwise.

Payment providers may process payment information in accordance with their own privacy notices and security standards. We may receive limited payment-related information, such as transaction identifiers, payment status, billing history, card type, card expiry date, and the last four digits of a payment card where applicable.

12. International processing

We are established in the United States. The Platform Owner is established in Cyprus, and some of our service providers, partners, or systems may process personal information in the United States, Cyprus, the European Union, or other countries.

If you access or use the Services from outside the United States, you understand that your personal information may be processed in countries where privacy laws may differ from those in your jurisdiction.

Where required by applicable law, we will use appropriate safeguards for international transfers of personal information.

13. Retention

We keep personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

Retention periods depend on the type of information, the purpose of processing, our relationship with you, the Services you use, and legal, accounting, tax, regulatory, security, fraud-prevention, and dispute-resolution requirements.

For example, we may retain account information while your account is active, subscription and transaction records for tax, accounting, chargeback, and legal compliance purposes, support communications for customer service and dispute-resolution purposes, and technical logs for security, diagnostics, and fraud-prevention purposes.

When personal information is no longer needed, we may delete, anonymize, or aggregate it.

  • opt out of certain profiling or automated decision-making where applicable law provides that right;

To process your request, we may need to verify your identity. In most cases, this means confirming that the request relates to the email address associated with your account. Depending on the type of request and how you use the Services, we may ask for limited additional information reasonably necessary to verify the request.

Where permitted by applicable law, you may use an authorized agent to submit a privacy request on your behalf. We may require information reasonably necessary to verify the request, your identity, and the agent’s authority.

If we deny your privacy request, you may have the right to appeal our decision by contacting us at privacy@omperty.com and stating that you are appealing a privacy-rights decision. Please include or reference the decision you are appealing so that we can review it.

We retain each category of personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain accounts, process subscriptions and refunds, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and maintain security.

17.5. California Shine the Light

The Services are not intended for children or individuals under 18 years of age. You must not use the Services if you are under 18 years of age.

We do not knowingly collect personal information from children or individuals under 18 in connection with the Services.

19. Automated decision-making and profiling
